Law, Literature and HistoryRonald Dworkin, professor of jurisprudence at University College London and the New York University School of Law, delivers the inaugural Frederic R. and Molly S. Kellogg Biennial Lecture on Jurisprudence in the Coolidge Auditorium of the Library of Congress.

Speaker Biography: Born in Worcester, Mass., Ronald Dworkin was educated at Harvard University and Magdalen College, Oxford, where he was a Rhodes Scholar and a student of prominent British lawyer and academic Sir Rupert Cross. Dworkin attended Harvard Law School and subsequently clerked for Judge Learned Hand of the United States Court of Appeals for the Second Circuit. A former professor of jurisprudence at the University of Oxford, Dworkin is widely known as one of the foremost American legal philosophers. He is the author of many articles in philosophical and legal journals and has written numerous books, as well as articles on legal and political topics in the New York Review of Books. In 2007, Dworkin was awarded the Holberg Memorial Prize in the Humanities by the Kingdom of Norway.

Lets begin with a sport. Say wrestling, way back in the 80s and 90s wrestling was a dominant sport in the United Sates. Major promotions like the World Championship of Wrestling and the World Wrestling Entertainment promoted the event through various house shows. Later these events were broadcasted through the television media and look where the game stands today. Even in India every single household has a member dedicated to the sport. A small example is that of the “Great Khali” who has held the world heavyweight championship. And this was only possible because of a Sport Marketing Company. Titan Sports in collaboration with TNT did the trick. According to W.Shank (Sports Marketing Executive ) “Sport Marketing refers to specific application of marketing principles and process to Sports product and marketing of non stop products that associate with sports”. Products associated with sports include various things like Player Endorsements, testimonials, event marketing and stadium advertising. All in all it raises the money involved with the game and hence the standard of the game on a whole.

Lets take the case of a Sports Marketing Company in India. In India the game that gets the maximum amount of attention is cricket. When the inaugural world cup was held way back in 1975, a player of the Indian Cricket Team at the most earned a sum of Rs 2000 for a one day match and 1500 per day for a test match. Forward to the year 2008. A player with the smallest contract is paid approx. RS 35,000/ for a one-day series and Rs 40,000/ per day for a test match. This was only possible as people started taking interest in the game. Television channels, newspapers, advertisement hoardings all took required measures to make the game immensely popular. Commercials aired on TV featured players endorsing brands or commodities that were popular with the general public, thereby making these players household names. If a Survey is conducted on the top 5 richest sports persons in Asia, the names would undoubtedly be Sachin Tendulkar, Saurav Ganguly, Sania Mirza, Vishwanathan Anand and Shoaib Akhtar. Technically speaking the survival of a sports marketing company is in the hands of it’s promoters, i.e the companies that sponsor the sport event.

Generally speaking the functioning and more importantly the success of the sports marketing company lies in the hand of it’s partner. Good publicity of a player is needed. This is where a public relation agency is needed. As sports is primarily into entertainment a media and entertainment company is also needed. Going by the current standards the two biggest sports marketing companies in India NEO sports and Nimbus were recently formed and in no time has had a good grip in all sporting events in India. Currently in India sports marketing is a multi billion dollar industry. Players such as Mahendra Singh Dhoni, Yuvraj Singh, Sania Mirza and many more are finding ways to make millions of rupees. They are getting outstanding deals to wear clothing during events, or do a commercial, or a photo shoot for and advertisement. New content distribution channels like the Web, email, voice messaging, streaming video and mobile are creating many new opportunities and challenges for sports marketers who formerly found newspapers, daily/weekly magazines and television as a channel for promotion. Due to growth of the industry and to support the demands for employees numerous institutions have opened up Sports Marketing as a subject. All in all with passing times, the demand of a sports marketing firm has become extremely high.

Targeting the aim with a clever and sharp eye like a Hawk, The Atlanta Hawks are an American professional basketball team based in Atlanta, Georgia. They are part of the Southeast Division of the Eastern Conference in the National Basketball Association (NBA). The franchise was formed in 1946 and their final relocation took place in 1968, when the Hawks moved to Atlanta, Georgia. The franchise was formed in 1946 as the Tri-Cities Blackhawks in the Quad Cities area.

The Blackhawks eventually became one of the National Basketball Association’s 17 original teams after a merger in 1949 of the 12-year-old National Basketball League and the four-year-old Basketball Association of America. The Blackhawks reached the playoffs in the NBA’s inaugural year, under the leadership of coach Red Auerbach. However, the following season, they failed to qualify for the postseason. Despite this, the Hawks were one of the league’s worst teams, and in 1955 the Hawks moved yet again, this time to St. Louis, MO.

The Hawks became one of the league’s top teams as a result of the acquisitions in the draft and free agency. The team advanced to the 1957 NBA Finals, losing to the Boston Celtics in game seven. In 1958, the Hawks again advanced to the NBA Finals and captured their only NBA Championship in game 6 against the Celtics. The Hawks remained one of the NBA’s premier teams for the next decade. In 1960, , the team advanced to the Finals yet again, but lost—again to the Celtics—in yet another game seven thriller. The following year, with the acquisition of rookie Lenny Wilkens, the Hawks repeated their success, but met the Celtics in the Finals again and lost in five games. Thus this victory and loss session brought forward its own implications and the team took it with an open heart.

The next few years the Hawks remained contenders, every year advancing deep into the playoffs and also capturing several division titles. Despite the success, Kerner became wary of the now-aging 10,000-seat Kiel Auditorium. The larger St. Louis Arena was not well-maintained since the 1940s, and Kerner wanted a new arena to increase revenue. However, he was rebuffed by the city on several occasions. As a result in 1968, the team was sold to Atlanta real estate developer Tom Cousins and Georgia Governor Carl Sanders and moved to Atlanta, Georgia. While a new arena was being constructed, the team spent its first four seasons playing in Georgia Tech’s Alexander Memorial Coliseum. Cousins’ firm soon developed the Omni Coliseum, a 16,500-seat, state-of-the-art downtown Atlanta arena, for the Hawks and the expansion Atlanta Flames hockey franchise, which opened in 1972 as the first phase of a massive sports, office, hotel and retail complex, most of which is now the CNN Center. With the new arena, the team was rejuvenated again to face the challenges ahead with renewed enthusiasm.

In 1977 Hubie Brown was hired to become head coach by Ted Turner who just bought the team. Ted Turner also owned Atlanta Braves. In 1979 the Hawks team compiled 50 wins and the title for Central Division. In 1982 the franchise acquired superstar Dominique Wilkins, who was able enough to help Hawks to score 50 plus victories, each time, in next four years. But unfortunately, the team could not advance past the semifinals of the playoffs.

In 1993, Lenny Wilkens was hired as coach. In the 1993- 1994 season coach Wilkens led the team to 57 victories, a team record, and in 1995 Wilkens broke the record (previously held by former Hawk coach Red Auerbach) for most victories by an NBA head coach with victory number 939.

However, lately Hawks team has struggled, and again they are considered as one of the worst team in the league. Some analysts say that this bad performance by Atlanta Hawks in recent years is due to major reshuffle in the management of the team, as it was sold to a group of executives by the name of Atlanta Spirit LLC by Time Warner in year 2004. Time Warner themselves had inherited the franchise and Braves after its merger with Turner Broadcasting in 1996.

Even these changes in ownership could not help the Hawks and they kept on struggling for their performance. In the 2004-2005 season, the Hawks earned the notorious reputation of the league’s worst team with a only 13 victories.

However, hope started emerging for Hawks in 2007, when in third pick of the NBA draft; they selected Al Horford Acie Law IV in 9th draft.

Combination made the team win its first ever season opener against Dallas Mavericks after 1998. This 101–94 win sent plenty of hopes towards Hawks fans. But the pleasant atmosphere didn’t last for long and Hawks organization again went uncertain when the NBA granted the first appeal of a protested game against Miami Heat in 25 years on January 11, 2008. This made their certain victory doubtful.

The World Economic Forum asked me to write “an 800 words summary of your most compelling actionable idea on the challenges of aging and gerontology”, in preparation for the Inaugural Summit of the Global Agenda taking place November 7 to 9th in Dubai.

Here you have my proposal to create a Global Consortium for Brain Fitness and Training Innovation and help ensure that “No Brain is Left Behind”:

I. The Context

- Growing Demands on Our Brains: Picture 6.7 billion Primitive Brains inhabiting a Knowledge Society where lifelong learning and mastering constant change in complex environments are critical for productive work, health and personal fulfillment.

Welcome to Planet Earth, 2008.

- Further stretched by increased longevity: Now picture close to 1 billion of those brains over the age of 60 – and please remember that, less than 100 years ago, life expectancy was between 30 to 40 years. The rapidly evolving Knowledge Society is placing new and enormous demands on our “primitive” human brains. And the longer our lifespans, the more obvious the “cognitive gap”. Hence, from a health point of view, the growing prevalence of Alzheimer’s Disease and its precursor Mild Cognitive Impairment. And, from a workplace point of view, the perception that older workers can’t learn new tricks, and are to be substituted by younger employees as soon as practical.

- Significance of lifelong neuroplasticity: The good news is that substantive brain research is showing how our brains retain lifelong neuroplasticity (the ability of our brains to rewire themselves responding to experience), how they can physically be strengthened -via the Cognitive/ Brain Reserve- and its functions enhanced, opening the way to slow-down if not reverse the cognitive decline that often comes with age. Use it and Improve It may be more accurate than Use It or Lose It, and help close the growing cognitive gap. Humans can become the gardeners of our own brains by focusing on four pillars: a balanced diet, cardiovascular physical exercise, stress management and brain exercise that incorporates well-directed novelty, variety and challenge.

- Cognitive neuroscience and neuropsychology are ready to step up: a growing number of research-based frameworks and applications present clear mainstream opportunities, yet they are often misunderstood, since they are presented in fragmentary and confusing ways. Think about the potential for having an annual “mental check-up” that helps set up a baseline and identify appropriate interventions. Think about being able to pinpoint specific needs and enhance, in non-invasive ways, specific neurocognitive functions, such as visual and auditory processing speed, working memory, executive functions, emotional self-regulation, attention.

II. The Problem

- We need bridges: There seems to be multiple areas of disconnect between gerontology, preventive healthcare overall, cognitive neuroscience and neuropsychology. Innovative and collaborative partnerships will be required to transform the growing amount of mainstream interest and research findings into a rational, interdisciplinary, and sustainable approach to neurocognitive fitness.

- Growing confusion among consumers and professionals: there are no “magic pills” or “general solutions”, but very useful tools when used appropriately. Better assessments, taxonomies and integrated research efforts are required for the field to mature. Some brain functions tend to improve as we age, whereas some tend to decline. For example, as executives tackle many difficult situations over time, we grow an “intuition” (or crystallized pattern-recognition) for best approaches. As long as the environment does not change too rapidly, we can continue to accumulate wisdom. But some areas of mental functioning typically decline. We usually see this in areas that test our capacity to learn and adapt to new environments, such as effortful problem-solving in novel situations, processing speed, working memory, and attention. Research has shown that all these areas can be enhanced in older brains. But the priorities are not the same for all individuals, or for all objectives (safer driving, preventing Alzheimer’s symptoms, improving memory…) In summary, the field holds much promise, but the picture is complicated.

III. The Opportunity

- A Global Consortium for Brain Fitness and Training Innovation composed of 100 leading universities, policy-makers, healthcare/ insurance providers and developers of technology-based neurocognitive assessments and training tools can provide the taxonomy, guidance and structure required to guide applications of cognitive neuroscience and neuropsychology in gerontology and geriatrics -and healthcare overall.

- A transparent online presence could facilitate the engagement of professionals and the public at large. Especially, yes, of brains over 60.

- Outcomes:

1) Best practices: to share best practices in preventive brain health education, seniors housing, hospital-based programs, insurance-led initiatives, public policy efforts.

2) Standards: to define standards for neurocognitive assessments and training tools,

3) Taxonomy: to establish a common taxonomy and language,

4) Education: to engage professionals and the public at large in well-informed “brain maintenance”,

5) Policy readiness: to anticipate policy implications and improve readiness,

6) Research path: to propose a research and applications path.
